What types of injuries are covered by workers’ compensation in Indiana?
Workers’ compensation covers most injuries that occur in the course and scope of employment. This includes sudden accidents (like falls or machinery injuries), repetitive stress injuries (such as carpal tunnel) and occupational illnesses (like those resulting from long-term chemical exposure). If you’re unsure whether your injury qualifies, we offer free consultations to provide work injury claim answers in Indiana.
How long do I have to file a workers’ compensation claim in Indiana?
You must report your injury to your employer within 30 days. If your claim is disputed or unresolved, you can pursue benefits by filing an Application for Adjustment of Claim with the Indiana Workers’ Compensation Board. This must be done within two years of the injury or your last workers’ comp payment. Missing these deadlines can jeopardize your claim.
Can I choose my own doctor for a work injury in Indiana?
Not usually. Indiana law allows your employer to select the treating physician. If you seek treatment outside of their network without approval, those costs may not be covered. However, you may request a second opinion or an Independent Medical Examination (IME) if you disagree with your diagnosis or treatment plan.
Can I be fired for filing a workers’ compensation claim in Indiana?
No. Indiana law prohibits employers from firing you in retaliation for pursuing a workers’ comp claim. However, Indiana is an at-will employment state, meaning employers can terminate workers for other reasons. If you suspect retaliation, we can help you protect your workers’ rights after a work injury.
